Cryptopia Portal Terms and Conditions
  • Application:  These terms apply to your use of the Cryptopia Portal at https://portal.cryptopia.co.nz/ (Portal).  In order to register on the Portal, you must accept these terms. These terms are a binding contract between you, the user of the Portal, and us, Cryptopia Limited (in liquidation), acting via our liquidators, Messrs David Ruscoe and Russell Moore of Grant Thornton New Zealand.  
  • Liability: Nothing in these terms excludes or limits our liability under mandatory provisions of applicable law that cannot be excluded (for example, under the Companies Act 1993). However, except for liability under those laws, we (Cryptopia Limited (in liquidation), its liquidators, their agents, Grant Thornton, its directors and employees) exclude any and all liability (whether in contract, tort, including negligence, under statute, in equity or otherwise), arising directly or indirectly in connection with the Portal or your use of the Portal.
  • Eligibility:  You may only register on the Portal if you are a Cryptopia account holder who had a positive coin balance (including a Cryptopia Loss Marker) as at the date of liquidation (14 May 2019) and/or has an admissible claim in the liquidation of Cryptopia (Qualifying Cryptopia Account Holder).  
  • Registration:  In order to register on the Portal, you must fill out the registration forms provided, to verify your identity, provide contact details and to confirm that you are Qualifying Cryptopia Account Holder.  Our Privacy Policy https://portal.cryptopia.co.nz/CryptopiaPrivacyPolicy.aspx applies to the personal information that we collect about you, and explains what we collect and how we treat that information.  You must ensure that all registration information, and other information that you provide to us via the Portal, is true, complete and accurate in all respects.  If your details change or the information you have provided becomes out of date, you must update it on the Portal
  • Contacting you:  You consent to us contacting you by electronic message in connection with the Portal, and the liquidation of Cryptopia Limited, using the details you provide on the Portal.
  • Using the Portal:  When using the Portal you must:
    • follow our instructions, as we publish on the Portal from time to time;
    • only use the Portal for lawful and legitimate purposes; 
    • not interfere with the operation of the Portal, any user or operator of the Portal, or any underlying software, hardware, system or network;
    • respect and not interfere with any access or copy protection, authentication, security or other features or protections on the Portal; 
    • comply with all applicable laws and not breach our or anyone else's rights;
    • not authorise, permit or enable any other person to do something contrary to these terms. 
  • Our rights:  If we have reason to believe that you may be using the Portal in breach of these terms or applicable law, we may take steps to suspend or terminate your use of the Portal with or without notice. 
  • Changes to the Portal:  We determine what functionality we make available on the Portal, and we will make changes to the Portal without notice from time to time.  For example, we may: 
    • Add new functionality to the Portal, or change or remove existing functionality;
    • Change our instructions for using the Portal;
    • Add, remove or replace different third-party features or tools that integrate with the Portal;
    • Replace or withdraw the Portal altogether.
    If we make a major change to the Portal that we think will have a material impact on a significant number of registered users, we will notify registered users of the change, either via the Portal or by email. 
  • Service limitations:  We do not warrant that the Portal will always operate as intended, be free from errors, or that any errors will be corrected, especially because we rely on the internet, and other third party networks, systems and services.  If you notice an issue with the Portal, please let us know and we'll see what we can do about it.  However, please note that:
    • while we take reasonable steps to secure information stored on or transmitted via the Portal, the internet is never completely secure and we cannot guarantee security;
    • we have regular maintenance windows when the Portal or certain features/functions may not be available;
    • we are not responsible for third party outages, or any other cause or event beyond our reasonable control.  
  • General:
    • We may amend these terms in our sole discretion from time to time.  We will notify registered users of the Portal of any changes when they come into effect, either via the Portal or by email.  If you do not agree with the amended terms, then you may cease use of the Portal. 
    • These terms are subject to New Zealand law and you submit to the non-exclusive jurisdiction of the New Zealand courts. 
    • All copyright and other intellectual property rights in the Portal belong to us or our licensors.  Provided that you comply with these terms and all applicable laws, we grant you a limited licence to access and use the Portal (in the manner that we provide it) for the purpose of communicating with us and making genuine claims for your account balance and (potentially) other entitlements as part of the liquidation of Cryptopia.  You must not, and you must not permit, authorise, enable or allow any other person to:
      • access the Portal without authorisation;
      • copy, adapt, play or show in public, or communicate to the public, any part of the Portal (or any part of it or its underlying code); or
      • otherwise redistribute, resupply, retransmit, reverse-engineer, decode, decompile, reformat or interfere with the Portal.  
    • We may freely at any time transfer or assign the operation of Portal and/or any part of, or all of our rights and obligations under, these terms to a third party. You must not transfer or assign any of your rights or obligations under these terms to any other person.

    • If any part of these Terms is held to be invalid, unenforceable or illegal, then the rest of these Terms will continue in full force and effect.
